Summary from the ITC: “Notice is hereby given that, on July 23, 2020, the presiding administrative law judge (“ALJ”) issued an initial determination (“ID”) (Order No. 40) in the above-captioned investigation, granting summary determination on violation of section 337 and including a recommended determination (“RD”) on remedy and bonding. The Commission has determined not to review the ID. The Commission requests briefing from the parties, interested government agencies, and interested persons on the issues of remedy, the public interest, and bonding.”
Summary from the ITC: “Notice is hereby given that the U.S. International Trade Commission (the “Commission”) has determined to: Review a Remand Initial Determination (“Remand ID”) finding that the complainant The Chamberlain Group, Inc. (“CGI”) has satisfied the economic prong of the domestic industry requirement with respect to U.S. Patent No. 7,755,223 (“the ’223 patent”); and request supplemental briefing on remedy, the public interest, and bonding for the limited purpose of updating submissions submitted in March 2020.”
Summary from the ITC: “Notice is hereby given that the U.S. International Trade Commission has determined to affirm in part and reverse in part a remand initial determination (“RID”) of the presiding administrative law judge (“ALJ”) in the above-captioned investigation. The Commission has issued a general exclusion order (“GEO”) directed to footwear products that infringe U.S. Trademark Registration No. 4,398,753 (“the '753 trademark”), and cease and desist orders (“CDOs”) directed to two respondents found in default. The investigation is terminated in its entirety.”
Notice of Receipt of Complaint; Solicitation of Comments Relating to the Public Interest
Summary from the ITC: “Notice is hereby given that the U.S. International Trade Commission has received a complaint entitled Certain Video Processing Devices, Components Thereof, and Digital Smart Televisions Containing the Same, DN 3489; the Commission is soliciting comments on any public interest issues raised by the complaint or complainant's filing pursuant to theStart Printed Page 57883Commission's Rules of Practice and Procedure.”
Certain Frozen Fish Fillets From Vietnam; Cancellation of Hearing for Third Full Five-Year Review
Supplementary information from the ITC: “Effective May 11, 2020, the Commission established a schedule for the conduct of this review (85 FR 28981, May 14, 2020). Counsel for Catfish Farmers of America, an association of domestic catfish growers and processors, and individual U.S. catfish processors America's Catch; Alabama Catfish, LLC d/b/a Harvest Select Catfish, Inc.; Consolidated Catfish Companies, LLC d/b/a Country Select Catfish; Guidry's Catfish, Inc.; Heartland Catfish Company; Magnolia Processing, Inc. d/b/a Pride of the Pond; and Simmons Farm Raised Catfish, Inc., domestic producers, filed a request to appear at the hearing. Counsel for the domestic parties also filed a request for consideration of cancellation of the hearing. Counsel indicated a willingness to submit written responses to any Commission questions in lieu of an actual hearing. No other party has entered an appearance in this review. Upon consideration of the request, the Commission determined that, in lieu of the public hearing in connection with this review, scheduled to begin at 9:30 a.m. on Tuesday, September 15, 2020, interested parties who timely made a request to appear at the hearing are invited to respond to any written questions posed by the Commission in their posthearing briefs, which are due to be filed on September 22, 2020.”
Chassis and Subassemblies From China; Determinations
Determination from the ITC: “On the basis of the record [1] developed in the subject investigations, the United States International Trade Commission (“Commission”) determines, pursuant to the Tariff Act of 1930 (“the Act”), that there is a reasonable indication that an industry in the United States is materially injured by reason of imports of certain chassis and subassemblies thereof (“chassis”) from China, provided for in subheadings 8716.39.00 and 8716.90.50 of the Harmonized Tariff Schedule of the United States, that are alleged to be sold in the United States at less than fair value (“LTFV”) and to be subsidized by the government of China.[2]”
Methionine From France, Japan, and Spain; Determinations
Determination from the ITC: “On the basis of the record [1] developed in the subject investigations, the United States International Trade Commission (“Commission”) determines, pursuant to the Tariff Act of 1930 (“the Act”), that there is a reasonable indication that an industry in the United States is materially injured by reason of imports of methionine from France, Japan, and Spain, provided for in subheadings 2930.40.00 and 2930.90.46 of the Harmonized Tariff Schedule of the United States, that are alleged to be sold in the United States at less than fair value (“LTFV”).[2]”
Summary from the ITC: “The Commission hereby gives notice of the scheduling of the final phase of antidumping and countervailing duty investigation Nos. 701-TA-637 and 731-TA-1471 (Final) pursuant to the Tariff Act of 1930 (“the Act”) to determine whether an industry in the United States is materially injured or threatened with material injury, or the establishment of an industry in the United States is materially retarded, by reason of imports of large vertical shaft engines from China, provided for in subheadings 8407.90.10, 8407.90.90, and 8409.91.99 of the Harmonized Tariff Schedule of the United States, preliminarily determined by the Department of Commerce (“Commerce”) to be subsidized and sold at less-than-fair-value.”
