Boltless Steel Shelving Units Prepackaged for Sale From China; Institution of Five-Year Reviews
Summary from the ITC: “The Commission hereby gives notice that it has instituted reviews pursuant to the Tariff Act of 1930 (“the Act”), as amended, to determine whether revocation of the antidumping and countervailing duty orders on boltless steel shelving units prepackaged for sale from China would be likely to lead to continuation or recurrence of material injury. Pursuant to the Act, interested parties are requested to respond to this notice by submitting the information specified below to the Commission.”
Prestressed Concrete Steel Wire Strand From China; Institution of Five-Year Reviews
Summary from the ITC: “The Commission hereby gives notice that it has instituted reviews pursuant to the Tariff Act of 1930 (“the Act”), as amended, to determine whether revocation of the antidumping and countervailing duty orders on prestressed concrete steel wire strand from China would be likely to lead to continuation or recurrence of material injury. Pursuant to the Act, interested parties are requested to respond to this notice by submitting the information specified below to the Commission.”
Polyethylene Terephthalate Film, Sheet, and Strip from China and the United Arab Emirates
Determinations from the ITC: “On the basis of the record developed in the subject five-year reviews, the United States International Trade Commission (“Commission”) determines, pursuant to the Tariff Act of 1930 (“the Act”), that revocation of the antidumping duty orders on polyethylene terephthalate film, sheet, and strip from China and the United Arab Emirates would be likely to lead to continuation or recurrence of material injury to an industry in the United States within a reasonably foreseeable time.”
Summary from the ITC: “The Commission hereby gives notice of the scheduling of the final phase of antidumping and countervailing duty investigation Nos. 701-TA-636 and 731-TA-1469-1470 (Final) pursuant to the Tariff Act of 1930 (“the Act”) to determine whether an industry in the United States is materially injured or threatened with material injury, or the establishment of an industry in the United States is materially retarded, by reason of imports of wood mouldings and millwork products from Brazil and China, primarily provided for in subheadings 4409.10.40, 4409.10.45, 4409.10.50, 4409.22.40, 4409.22.50, 4409.29.41, and 4409.29.51 of the Harmonized Tariff Schedule of the United States, preliminarily determined by the Department of Commerce (“Commerce”) to be subsidized and sold at less-than-fair-value.”
Summary from the ITC: “Notice is hereby given that the Commission has determined to affirm, with modified reasoning, an initial determination (“ID”) of the presiding administrative law judge (“ALJ”) granting summary determination on violation of section 337 by certain defaulting respondents. The Commission has also determined to issue a general exclusion order (“GEO”) barring entry of certain child resistant closures with slider devices having a user actuated insertable torpedo for selectively opening the closures and slider devices therefor that infringe the asserted claims of the three patents at issue in this investigation. This investigation is terminated.”
Certain Vacuum Insulated Flasks and Components Thereof; Institution of Investigation
Summary from the ITC: “Notice is hereby given that a complaint was filed with the U.S. International Trade Commission on July 29, 2020, under section 337 of the Tariff Act of 1930, as amended, on behalf of Steel Technology, LLC d/b/a Hydro Flask of Bend, Oregon and Helen of Troy Limited of El Paso, Texas. A supplement was filed on August 18, 2020. The complaint, as supplemented, alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain vacuum insulated flasks and components thereof by reason of infringement of: (1) The sole claims of U.S. Design Patent No. D806,468 (“the '468 patent”); U.S. Design Patent No. D786,012 (“the '012 patent”); U.S. Design Patent No. D799,320 (“the '320 patent”); and (2) U.S. Trademark Registration No. 4,055,784 (“the '784 trademark”); U.S. Trademark Registration No. 5,295,365 (“the '365 trademark”); U.S. Trademark Registration No. 5,176,888 (“the '888 trademark”); and U.S. Trademark Registration No. 4,806,282 (“the '282 trademark”). The complaint further alleges that an industry in the United States exists as required by the applicable Federal Statute.
The complainant requests that the Commission institute an investigation and, after the investigation, issue a general exclusion order, or in the alternative a limited exclusion order, and cease and desist orders.”
Kitchen Appliance Shelving and Racks From China; Scheduling of Expedited Five-Year Reviews
Summary from the ITC: “The Commission hereby gives notice of the scheduling of expedited reviews pursuant to the Tariff Act of 1930 (“the Act”) to determine whether revocation of the antidumping and countervailing duty orders on certain kitchen appliance shelving and racks from China would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.”
Summary from the ITC: “Notice is hereby given that the U.S. International Trade Commission (“Commission”) has determined to adopt the findings of the presiding Administrative Law Judge (“ALJ”) in the Recommended Determination (“RD”) and modify the limited exclusion order (“LEO”) and cease and desist order (“CDO”) issued in this investigation. The modification proceeding is terminated.”
Notice of Receipt of Complaint; Solicitation of Comments Relating to the Public Interest
Summary from the ITC: “Notice is hereby given that the U.S. International Trade Commission has received a complaint entitled Certain Filament Light-Emitting Diodes and Products Containing Same (II), DN 3486; the Commission is soliciting comments on any public interest issues raised by the complaint or complainant's filing pursuant to the Commission's Rules of Practice and Procedure.”
Certain Crystalline Silicon Photovoltaic Products From China and Taiwan
Determination from the ITC: “On the basis of the record developed in the subject five-year reviews, the United States International Trade Commission (“Commission”) determines, pursuant to the Tariff Act of 1930 (“the Act”), that revocation of the countervailing and antidumping duty orders on certain crystalline silicon photovoltaic products (“CSPV products”) from China and the antidumping duty order on CSPV products from Taiwan would be likely to lead to continuation or recurrence of material injury to an industry in the United States within a reasonably foreseeable time.”
