Summary from the ITC: “Notice is hereby given that the U.S. International Trade Commission (“Commission”) has determined not to review two initial determinations (“IDs”) (Order Nos. 23 and 24) of the presiding administrative law judge (“ALJ”), which terminated the investigation as to certain respondents based upon withdrawal of the complaint (Order No. 23), and terminated the investigation in its entirety based upon withdrawal of the complaint (Order No. 24). The investigation is terminated.”
Summary from the ITC: “Notice is hereby given that the U.S. International Trade Commission has found a violation of section 337 of the Tariff Act of 1930 (“section 337”), as amended, in this investigation. The Commission has issued a limited exclusion order (“LEO”) prohibiting the importation by respondent Jennewein Biotechnologie GmbH (“Jennewein”) of Rheinbreitbach, Germany of certain human milk oligosaccharides that infringe complainant's asserted claims. The investigation is terminated.”
Summary from the ITC: “Notice is hereby given that a complaint was filed with the U.S. International Trade Commission on April 21, 2020, under section 337 of the Tariff Act of 1930, as amended, on behalf of Sharp Corporation of Japan and Sharp Electronics Corporation of New Jersey. Supplements to the complaint were filed on April 22, 2020, May 4, 2020, and May 12, 2020. The complaint, as supplemented, alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain liquid crystal display devices, components thereof, and products containing the same by reason of infringement of certain claims of U.S. Patent No. 7,245,329 (“the '329 patent”); U.S. Patent No. 7,372,533 (“the '533 patent”); U.S. Patent No. 8,022,912 (“the '912 patent”); U.S. Patent No. 8,451,204 (“the '204 patent”); and U.S. Patent No. 8,847,863 (“the '863 patent”). The complaint further alleges that an industry in the United States exists as required by the applicable Federal Statute.
The complainants request that the Commission institute an investigation and, after the investigation, issue a limited exclusion order and cease and desist orders.”
Generalized System of Preferences: Possible Modifications, 2020 Review
Summary from the ITC: “Following receipt of a request on May 4, 2020, from the United States Trade Representative (USTR), the U.S. International Trade Commission (Commission) instituted Investigation No. 332-578, Generalized System of Preferences: Possible Modifications, 2020 Review, for the purpose of providing advice and information relating to the possible addition of articles and removal of articles.”
Ceramic Tile from China; Determinations
Determination from the ITC: “On the basis of the record developed in the subject investigations, the United States International Trade Commission (“Commission”) determines, pursuant to the Tariff Act of 1930 (“the Act”), that an industry in the United States is materially injured by reason of imports of ceramic tile from China, provided for in heading 6907 of the Harmonized Tariff Schedule of the United States, that have been found by the U.S. Department of Commerce (“Commerce”) to be sold in the United States at less than fair value (“LTFV”), and to be subsidized by the government of China.”
Summary from the ITC: “Following receipt on March 17, 2020, of a request from the United States Trade Representative (USTR), the Commission instituted Investigation Nos. TA-131-046 and TPA-105-007, U.S.-Kenya Trade Agreement: Advice on the Probable Economic Effect of Providing Duty-free Treatment for Currently Dutiable Imports.”
