Recommended Modifications in the Harmonized Tariff Schedule, 2020
Summary from the ITC: “On October 1, 2019, the U.S. International Trade Commission (Commission) instituted Investigation No. 1205-13, Recommended Modifications in the Harmonized Tariff Schedule, 2020. The Commission's proposed recommendations relating to Investigation No. 1205-13 have been posted on the Commission website. Interested Federal agencies and the public are invited to submit written comments on the proposed recommendations by December 14, 2020.”
Summary from the ITC: “The Commission hereby gives notice of the scheduling of the final phase of antidumping and countervailing duty investigation Nos. 701-TA-639-642 and 731-TA-1475-1492 (Final) pursuant to the Tariff Act of 1930 (“the Act”) to determine whether an industry in the United States is materially injured or threatened with material injury, or the establishment of an industry in the United States is materially retarded, by reason of imports of common alloy aluminum sheet from Bahrain, Brazil, Croatia, Egypt, Germany, Greece, India, Indonesia, Italy, Korea, Oman, Romania, Serbia, Slovenia, South Africa, Spain, Taiwan, and Turkey, provided for in statistical reporting numbers 7606.11.3060, 7606.11.6000, 7606.12.3096, 7606.12.6000, 7606.91.3095, 7606.91.6095, 7606.92.3035, and 7606.92.6095 of the Harmonized Tariff Schedule of the United States, preliminarily determined by the Department of Commerce (“Commerce”) to be sold at less-than-fair-value, and subsidized by the Governments of Bahrain, Brazil, India, and Turkey.”
Summary from the ITC: “Notice is hereby given that the U.S. International Trade Commission has determined not to review an initial determination (“ID”) (Order No. 6) of the presiding administrative law judge (“ALJ”) terminating the investigation with respect to respondents East West Manufacturing, LLC and East West Industries (collectively, “Respondents”) based on a consent order stipulation. The Commission has entered a consent order and terminated the investigation in its entirety.”
Certain Electric Shavers and Components and Accessories Thereof; Institution of Investigation
Summary from the ITC: “Notice is hereby given that a complaint was filed with the U.S. International Trade Commission on October 13, 2020, under section 337 of the Tariff Act of 1930, as amended, on behalf of Skull Shaver, LLC of Moorestown, New Jersey. A supplement was filed on October 29, 2020. The complaint, as supplemented, alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain electric shavers and components and accessories thereof by reason of infringement of certain claims of U.S. Patent No. 8,726,528 (“the '528 patent”) and U.S. Patent No. D672,504 (“the '504 patent”). The complaint further alleges that an industry in the United States exists as required by the applicable Federal Statute. The complainant requests that the Commission institute an investigation and, after the investigation, issue a general exclusion order, or in the alternative a limited exclusion order, and cease and desist orders.”
Notice of Receipt of Complaint; Solicitation of Comments Relating to the Public Interest
Summary from the ITC: “Notice is hereby given that the U.S. International Trade Commission has received a complaint entitled Certain Sponge or Foam Products, DN 3506; the Commission is soliciting comments on any public interest issues raised by the complaint or complainant's filing pursuant to the Commission's Rules of Practice and Procedure.”
Summary from the ITC: “Notice is hereby given that the U.S. International Trade Commission (“Commission”) has determined not to review the Administrative Law Judge's (“ALJ”) initial determination (“ID”) (Order No. 22) granting the complainant's motion for leave to amend the complaint and notice of investigation.”
Aluminum Foil From Armenia, Brazil, Oman, Russia, and Turkey
Determinations from the ITC: “On the basis of the record [1] developed in the subject investigations, the United States International Trade Commission (“Commission”) determines, pursuant to the Tariff Act of 1930 (“the Act”), that there is a reasonable indication that an industry in the United States is materially injured by reason of imports of aluminum foil from Armenia, Brazil, Oman, Russia, and Turkey, that are alleged to be sold in the United States at less than fair value (“LTFV”) and imports of aluminum foil that are allegedly subsidized by the governments of Oman and Turkey.[2] The products subject to these investigations are primarily provided for in subheadings 7607.11.30, 7607.11.60, 7607.11.90, and 7607.19.60 of the Harmonized Tariff Schedule of the United States (“HTS”).”
